Welcome to Empathy Mobility Services LLC. These Terms of Service outline the rules and guidelines for using our website and booking our transportation services. By accessing our site or scheduling a ride, you agree to follow these terms. Please read them carefully.

1. Our Services

We provide specialized transportation solutions, including Non-Emergency Medical Transport (NEMT), wheelchair-accessible rides, dialysis transport, and door-to-door assistance.

Important Notice: We are strictly a non-emergency transport provider. Our vehicles are not equipped to handle medical emergencies, and our drivers are not medical professionals. If you or a family member experience a medical emergency, please call 911 immediately.

2. User Responsibilities

To ensure a safe and smooth journey for everyone, we ask that you meet the following responsibilities:

  • Accurate Information: You must provide complete and correct details when booking. This includes the exact pickup and drop-off addresses, appointment times, and any specific mobility requirements (such as wheelchair size or the need for a travel companion).
  • Punctuality: Please be ready at the agreed pickup time. Our drivers often operate on tight schedules to ensure all passengers reach their medical appointments on time.
  • Behavior: We expect all passengers to treat our drivers and staff with respect. We reserve the right to refuse service to anyone who behaves aggressively or compromises the safety of the ride.

3. Payment Terms

You agree to pay all charges associated with the services you book.

  • We will provide a clear fare estimate before you confirm your ride.
  • We accept major credit cards and other approved payment methods.
  • Payment is generally due at the time of booking or upon completion of the ride, depending on the arrangement made during scheduling.
  • If you use insurance or a third-party payer, you remain responsible for any unpaid balances or denied claims.

4. Cancellation and No-Show Policy

We understand that medical appointments and plans change. If you need to cancel or reschedule your ride, please contact us as soon as possible.

  • Advance Notice: We request at least 24 hours of notice for any cancellations.
  • Late Cancellations: If you cancel with less than 24 hours of notice, we may charge a late cancellation fee.
  • No-Shows: If our driver arrives at the scheduled time and location, and you are not there or choose not to ride, you will be charged the full price of the trip.

5. Limitation of Liability

We strive to provide reliable and punctual service. However, certain events fall outside our control.

  • We are not responsible for delays caused by heavy traffic, severe weather, road closures, or mechanical issues.
  • We are not liable for any costs or damages resulting from missed appointments or delayed arrivals.
  • While our team provides physical assistance from your door to our vehicle, we do not provide medical care. You assume responsibility for your medical stability during transport.

6. Dispute Resolution

We always prefer to resolve any issues directly with you. If you have a concern or complaint, please reach out to our customer service team first. If we cannot resolve the dispute informally, any legal action or arbitration must take place in Hennepin County, Minnesota. These terms are governed by the laws of the State of Minnesota.

7. Changes to These Terms

We may update these Terms of Service periodically to reflect changes in our business or legal requirements. When we make updates, we will change the effective date at the top of this document. Your continued use of our services means you accept the revised terms.
